Terms and Conditions of Sale

Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 : up to 14 days after receiving your goods, in most cases, you can change your mind and get a full refund.

Consumer Rights Act 2015 : The Consumer Rights Act 2015 sets out that goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product your legal rights entitle you to the following:

  • Up to 30 days: if your goods are faulty, then you can get a refund. Up to six months: if your goods can't be repaired or replaced, then you're entitled to a full refund, in most cases.
  • Up to six years: if your goods do not last a reasonable length of time you may be entitled to some money back.

This contract sets out:
• your legal rights and responsibilities;
• our legal rights and responsibilities; and
• certain key information required by law.

In this contract:
•‘We’, ‘us’ or ‘our’ means INDUSTRIAS COSMIC, S.A.U. ("Cosmic") and
•‘You’ or ‘your’ means the person using https://www.cosmicbrand.com to buy goods from us.

We are Industrias Cosmic S.A. (trading as COSMIC BRAND), a company registered in UK under the VAT number: GB441491504000.

  1. Introduction
    1.1 All purchases made on the Cosmic Website are subject to these terms and conditions.
    1.2 This contract only applies to goods bought from our online site.
    1.3 This contract is only available in English. No other languages will apply to this contract.
    1.4 When buying any goods you also agree to be legally bound by:
      1. our website terms and conditions https://www.cosmicbrand.com/en/gb/terms-and-conditions  and any documents referred to in them, including our privacy policy https://www.cosmicbrand.com/en/gb/privacy-policy; and
      2. specific terms which apply to certain goods which are included on the webpage for the individual good to which they apply. If you want to see these specific terms, please visit the relevant webpage at any time during the online checkout process.

All of the above documents form part of this contract as though set out in full here.

  1. Your privacy and personal information
    1. Our Privacy Policy is available at https://www.cosmicbrand.com/en/gb/privacy-policy.
    2. Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information.
  1. Ordering goods from us
    1. Below, we set out how a legally binding contract between you and us is made:
      1. You place an order on the site by using the online checkout facility. Please read and check your order carefully before submitting it. However, if you need to correct any errors you can do so before submitting it to us.
      2. When you place your order at the end of the online checkout process, we will acknowledge it by email. This acknowledgement does not, however, mean that your order has been accepted.
      3. We may contact you to say that we do not accept your order. This is typically for the following reasons:
        1. the goods are unexpectedly out of stock;
        2. we cannot authorise your payment;
        3. you have ordered too many goods;
        4. we have withdrawn the product
        5. You have tried to order from a territory outside the UK; or
        6. there has been a mistake on the pricing or description of the goods.
      4. We will only accept your order after we have checked the order and we will email you to confirm this (Confirmation Email). At this point:
        1. a legally binding contract will be in place between you and us;
        2. we will take payment for the order; and
        3. we will dispatch the goods to you.
    2. If you are under the age of 18 you may not buy any goods from the site.
  1. Right to cancel
    1. You have the right to cancel this contract within 14 days of the date of delivery without giving any reason.
    2. The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
    3. To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement. You are required to complete a return request in your account, online at https://www.cosmicbrand.com/shop/sales/order/history.
    4. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
  1. Effects of cancellation
    1. If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).
    2. We may make a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result of handling by you which would not be acceptable in a showroom.
    3. We will make the reimbursement without undue delay, and not later than:
      1. 14 days after the day we received back from you any goods supplied; or
      2. (if earlier) 14 days after the day you provide evidence that you have returned the goods; or
      3. if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.
    4. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
    5. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
    6. If you have received goods you shall follow the returns process outlined in 7 to return the goods to us. In addition:
      1. you shall send back the goods or hand them over to us or, without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired;
      2. Cosmic will bear the cost of returning the goods and you should use the returns form available in your account online at https://cosmicbrand.returns.international/
      3. goods should be returned where practicable unopened, unused (not fitted) and in original packaging, however you are only liable for any diminished value of the goods resulting from the handling of the goods which goes beyond what is reasonably necessary for you to establish the nature, characteristics and functioning of the goods.
  1. Returns Process
    1. In order to make a return, you must authorise your return through the Cosmic website;
      1. on the return portal: https://cosmicbrand.returns.international/ or;
      2. under the “My Account” section online at https://www.cosmicbrand.com/shop/sales/order/history/, or;
      3. contact our Customer Services team at https://www.cosmicbrand.com/en/gb/customer-care
    2. You will then be issued with a logistics label.
    3. When preparing your item for return, please handle it with care and use its original packaging where possible. Make sure to mark your order number, return number, and reason for return clearly on a separate sheet. Remember, avoid marking directly on the original packaging and ensure that any goods that are in sealed packaging are clearly visible without the need to open the packaging.
    4. Once your item is securely packaged, kindly send it back to our depot in the following location: Dunton Distribution Centre, Christy Way, Basildon, SS15 6TR, United Kingdom.
    5. Once our depot receives your return, we will begin processing it.

Please note that it may take up to 10 working days from the date we receive your order for your refund to be processed. We will make the reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise.

    1. Please kindly note that we are unable to accept returns for unwanted items after 30 days from the receipt of goods.
    2. If you think that an item is damaged or faulty, please follow the process set out in 11 before starting the returns process.
  1. Delivery
    1. We will provide an estimated date and time window for delivery of the goods in the Confirmation Email (see clause 4.1.4).
    2. If something happens which:
      1. is outside of our control; and
      2. affects the estimated date of delivery

we will provide you with a revised estimated date for delivery of the goods. If your delivery is delayed by an event outside our control, and we have provided you with a revised estimated date for delivery of the goods, we will not provide compensation for the delay.

    1. Delivery of the goods will take place when we deliver them to the address that you gave to us.
    2. Unless you and we agree otherwise, if we cannot deliver your goods within 30 days, we will:
      1. Inform you of this ;
      2. cancel your order; and
      3. provide you with a refund.
    3. If nobody is available to take delivery, please contact us at support@cosmicbrand.com  to let us know.
    4. You are responsible for the goods when delivery has taken place. In other words, the risk in the goods passes to you when you take possession of the goods.
  1. Payment
    1. We accept the credit cards and debit cards listed on our website. We do not accept cash payments.
    2. We will do all that we reasonably can to ensure that all of the information you give us when paying for the goods is secure by using an encrypted secure payment mechanism.
    3. Your credit card or debit card will only be charged when the goods are allocated for delivery.
    4. All payments by credit card or debit card need to be authorised by the relevant card issuer.
    5. If your payment is not received by us and you have already received the goods, you:
      1. must pay for such goods within 30 days; or
      2. must return them to us as soon as possible. If so, you must keep the goods in your possession, take reasonable care of them (including ensuring that you follow any instructions or manuals given with the goods) and not use them before you return them to us.
    6. Nothing in this clause affects your legal rights to cancel the contract during the ‘cooling off’ period under clauses 5 and 6.
    7. The price of the goods:
      1. is in pounds sterling (£)(GBP);
      2. includes VAT at the applicable rate; and does not include the cost of delivering the goods (delivery prices are displayed at checkout before you place your order).
  2. Nature of the goods
    1. The Consumer Rights Act 2015 gives you certain legal rights (also known as ‘statutory rights’), for example, the goods:
      1. must be of satisfactory quality;
      2. must be fit for purpose; and
      3. must match the description, sample or model.
    2. Cosmic is committed to providing you with goods that comply with your legal rights. Whilst we try to make sure all weights, sizes and measurements set out on the site are as accurate as possible, there may be a small tolerance of up to 5% in such weights, sizes and measurements in the goods.
    3. A products true colour a may not exactly match that shown on your device or in our marketing or its packaging may be slightly different to that shown online.
    4. Any goods sold as substandard will be identified and sold as such. Please check that they are of a satisfactory quality for their intended use prior to ordering the product.
  3. Faulty goods
    1. If you think there is something wrong with your product, you must either contact our Customer Service Team https://www.cosmicbrand.com/en/gb/customer-care or submit our Damaged Item Form.
    2. We honour our legal duty to provide you with products that are as described to you on our website and that meet all the requirements imposed by law, summarised at the top this page. These are subject to certain exceptions. For detailed information please visit the Citizens Advice website www.citizensadvice.org.uk or call Citizens advice at 03454 04 05 06. Remember too that you have several options for resolving disputes with us.
    3. Please contact our customer service team https://www.cosmicbrand.com/en/gb/customer-care if you wish to exercise your rights and want:
      1. us to repair the goods;
      2. us to replace the goods;
      3. a price reduction; or
      4. to reject the goods and get a refund.
    4. Please note that if you inform us of a faulty products, we may request that you supply photographs of any damaged or faulty items.
  4. End of the contract
    1. If this contract is ended it will not affect our right to receive any money which you owe to us under this contract.
       
  5. Our responsibility to you
    1. We're responsible for losses you suffer caused by us breaking this contract unless the loss is:
      1. Unexpected: It was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it (so, in the law, the loss was unforeseeable).
      2. Caused by a delaying event outside our control: As long as we have taken the steps set out in section 8, we are not responsible for delays outside our control.
      3. Avoidable: Something you could have avoided by taking reasonable action, including following our reasonable instructions for use.
      4. A business loss : for example, a loss that relates to your use of a product for the purposes of your trade, business, craft or profession.
  6. Disputes
    1. If you are unhappy with the goods, our service to you or any other matter in relation to this agreement, you have several options for resolving disputes with us:
      1. Our Customer Service Team: Please contact our customer service team https://www.cosmicbrand.com/en/gb/customer-care who will do their best to resolve any problems you have with us or our products.
      2. Resolving disputes without going to court. Alternative dispute resolution is an optional process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. You can submit a complaint to the London Arbitration Centre through their website at https://londonarbitrationcentre.com/ . The London Arbitration Centre does not charge you for making a complaint and if you are not satisfied with the outcome you can still go to court.
      3. You can go to court. These terms are governed exclusively by the law of England and Wales and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.
  7. Third party rights
    This contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.
  8. Warranties
    1. At COSMIC, two of our most important objectives are: (1) to create the highest-quality products and (2) ensure our customer’s satisfaction.  Therefore, we are proud to provide you with a Limited Product Warranty (“Warranty”) on your purchases. This means that Cosmic makes a commitment to you that for a specified period, our products will meet their published product specifications, and are free from defects in material or craftsmanship.
    2. Whilst we try to make sure all weights, sizes and measurements set out on the site are as accurate as possible, there may be a small tolerance of up to 5% in such weights, sizes and measurements in the goods and we do not warrant otherwise.
    3. A products true colour a may not exactly match that shown on your device or in our marketing or its packaging may be slightly different to that shown online, such variation will not be considered a breach of warranty.
    4. This warranty to not extend to include :
      1. defects caused by failure to provide a suitable installation environment for the Product;
      2. defects caused by instillation carried out in a way that is not compliant with Cosmic instructions;
      3. damage caused by use of the Product for purposes other than those for which it was designed;
      4. damage caused by using the product in a way not compliant with the instructions and specification provided;
      5. damage caused by your improper, inadequate, or unauthorized attachments or modification of the products; and
      6. damage caused by general wear and tear, unless the damage has occurred due to a defect in materials or craftsmanship.
    5. The duration of your Warranty (“Warranty Period”) depends on the type of Products you purchased and is listed below.

    1. Within the applicable Warranty Period, if you discover the Product fails to conform to specifications or contains a defect in material or craftsmanship, you must promptly notify us in writing prior to the expiration of the applicable Warranty Period.
    2. We may ask you to return the damaged goods to us. When returning the goods please follow the returns period set out in 6 You will not have to pay for shipping costs to return the goods to us.
    3. >Within 30 days of receipt of your returned Product, COSMIC will:
      1. correct any failure of the Product to conform to our published specifications; or correct any defect in material or craftsmanship using either new replacement parts or used parts that are equal to new parts in performance and reliability.  We will cover the expense of repair and replacement of the COSMIC product (including both parts and labour).
      2. If we are unable to repair the Product to conform to the Warranty, we will have the option of providing you with:
        1. a replacement Product; or
        2. a full refund of the purchase price.
      3. When returning the repaired or replacement Product to you, we only will pay for standard shipping charges.  You will be required to pay for any additional shipping options (such as express shipping).
  1. Other Important Terms that apply to this Contract.
    1. If a court invalidates some of this contract, the rest of it will still apply. If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.

Even if we delay in enforcing this contract, we can still enforce it later. We might not immediately chase you for not doing something (like paying) or for doing something you're not allowed to, but that doesn’t mean we can't do it later.
